Lindsay Clancy holdout juror was reportedly accused of domestic violence

The lone holdout juror in the Lindsay Clancy murder trial was previously accused of domestic violence, according to a report.

The man, who has not been publicly identified, allegedly grabbed his wife by the throat and threw her into a dresser in September 2021, CBS News reported.

The juror’s 13-year-old nephew reportedly called 911, according to a Brockton, Massachusetts, police report obtained by CBS News. The Independent has asked the Brockton Police Department for comment.

The man was later charged with one count of domestic violence assault and battery and pleaded not guilty. The criminal charge was later dismissed, according to the report.

The holdout juror has not been publicly identified. Plymouth Superior Court has not made the jury list public.

The Independent has contacted Plymouth County District Attorney’s Office and Clancy’s attorney, Kevin Reddington for comment.

Clancy’s case ended in a mistrial September 4 after the jury was deadlocked three times.

Clancy, 36, a former labor and delivery nurse, admitted to killing her three children - Cora, 5, Dawson, 3, and 8-month-old Callan - in the basement of her Massachusetts home in 2023, before trying to take her life. Her suicide attempt left her partially paralyzed.

Her defense attorney argued that postpartum psychosis prompted her actions. Prosecutors argued that Clancy knew what she was doing when she killed her children.

After five weeks of testimony and seven days of deliberations, jurors were unable to reach a unanimous verdict on whether Clancy should be held criminally responsible for the killings.

Several jurors and Clancy’s lawyer have since suggested that the jury was split 11 to 1 in favor of finding Clancy not criminally responsible for the killings.

Jury foreperson Roni Carlson told NBC 10 last Tuesday that the holdout juror declared that he wouldn’t say Clancy was not guilty by reason of insanity — even though he had reasonable doubt.

“He admitted he had reasonable doubt. I started filling out the forms; I was so excited,” Carlson said.

The holdout juror then told her: “But I’m still not going to say she’s not guilty by reason of insanity.”

Other members of the jury, Paula Devlin and Kellie Farina, also told the outlet that the holdout juror didn’t seem to want to listen to instructions, including the judge’s definition of “reasonable doubt.”

“He actually said one day in the end, ‘Why don’t we have the judge come and read it again?’ and we were like ‘No, we have it in front of us,’” Devlin said.

“He was very arrogant,” Farina added. “He really did not take anything that anybody said.”

The jurors noted they were trying to figure out whether Clancy knew right from wrong and concluded that she didn’t because “everything proved she loved her children.”

“Everything proved that she loved her children, so she had to have snapped,” Carlson said.

District Attorney Timothy Cruz has not yet said whether the state will retry Clancy. The next court hearing is scheduled for September 29 in Plymouth Superior Court.
