The Madlanga Commission has refused to dismiss top cop general Feroz Khan's postponement application on Monday.
Evidence leaders urged the Commission to refer Khan to the National Prosecuting Authority (NPA) for non-attendance.
Khan was subpoenaed to testify on Monday; however, he has filed a notice of a postponement application.
